1.- Who is responsible for processing your data?

This Privacy Policy shall be applicable to the processing carried out by MAKAN LYDGROUP, S.L. of personal data collected by the following means: 

– the website www.elgalloazuljerez.com

– communications by e-mail/telephone.

– the management of the El gallo azul jerez restaurant itself.

– the video surveillance system

2.- What data do we collect and for what purposes? How long do we keep it? 

MAKAN LYDGROUP S.L. will collect different data depending on the functionalities of the website you use, how you interact with us through the website or when you come to our restaurant:

• RESERVATION FORM

Data: identifying information that you provide us with (name and surname, telephone number, email address). MAKAN LYDGROUP S.L. may also request details of your account number or bank cards for the provision of its services.

Purpose: To assist you as a customer and to manage your preferences and bookings, as well as to send you commercial communications.

Legitimate basis: The execution of a contract or pre-contract to which you are a party (art.6.1.b RGPD), with regard to the management of your reservations. Legitimate interest in relation to the sending of commercial communications from the restaurant (art. 6.1.f RGPD). And, in the event that you have expressed your wish to receive commercial communications sent by other MAKAN LYDGROUP S.L. restaurants, the legal basis is express consent (art. 6.1.a RGPD). 

Recipients: other companies in the MAKAN LYDGROUP S.L. group, provided that you, as a result of the suggestions we make, decide to make a reservation at another restaurant in the group, or you have expressly accepted the sending of commercial communications from these restaurants. 

Retention: the time strictly necessary to comply with each of the purposes foreseen plus, where appropriate, the limitation periods for contractual or pre-contractual liabilities.

• RESERVATION CONDITIONS:

The reservation will not be formalised until you receive an email confirming the validity of the reservation with all the corresponding information. 

If you wish to change the date of the reservation or the number of diners, your request will be dealt with as long as it is made at least one hour before the agreed time, and if there are places available. You can do this by calling the restaurant’s telephone number.

We inform you that days before the date and time booked, you will receive an email and sms where you must reconfirm or cancel the reservation in the links that are enabled for this purpose, if any.

Only once the booking has been reconfirmed by you from the email or SMS, will your booking be fully confirmed.

If you prefer, you can confirm your reservation by calling the restaurant before the reservation date.

The reservation will be held for a period of 15 minutes from the confirmed date and time, after which the reservation will be cancelled and the restaurant will be able to offer your table to other diners.

• VIDEO SURVEILLANCE

Data: Images captured by video surveillance systems.

Purpose: To ensure the security of persons, goods and facilities.

Legitimate basis: Legitimate interest of the data controller (art.6.1.f) RGPD) consisting of ensuring the security of persons, goods and facilities of MAKAN LYDGROUP S.L.

Recipients: They will not be transferred to anyone unless they are made available to the competent authority in the event that the images prove the commission of acts that threaten the integrity of persons, property or installations.

Retention: 30 days

• EMPLOYMENT FORM

Data: Data from the form provided on the website as well as your CV if you send it to us via our website.

Purpose: To manage personnel selection processes.

Legal basis: Consent of the data subject (art.6.1.a RGPD).

Recipients: Your data could be transferred to other companies of the MAKAN LYDGROUP GROUP if your profile could fit with any of the existing offers or vacancies so that they can evaluate your CV.

Retention: 1 year.

3.- Data transfer to third countries

MAKAN LYDGROUP S.L., as data controller, informs you that it does not intend to transfer your personal data to countries outside the European Union, although it cannot guarantee that some specific storage and processing activities will not be carried out by natural or legal persons located outside the European Union.

However, in the event that any processing activities are carried out by companies or individuals located in third countries, MAKAN LYDGROUP S.L. will take all necessary measures to ensure that your data is processed securely and in accordance with this Privacy Policy and will not transfer your personal data to an organisation or country outside the European Union, unless they are countries with an adequate level of protection or sufficient guarantees are provided and the data subject has enforceable rights and effective legal remedies.

4.- What are your rights when you provide us your data?

The data protection rights held by data subjects are:

• Right of rectification or erasure
• The right to object
• The right to request the restriction of their processing
• The right to data portability

The owners of the personal data obtained may exercise their personal data protection rights by sending a written communication to the registered office of MAKAN LYDGROUP S.L. or to the e-mail address provided for this purpose efecto,comunicacion@elgalloazuljerez.com, including in both cases a photocopy of their National Identity Card or other equivalent identification document.

 5.- Can I withdraw my consent?

You have the possibility and the right to withdraw your consent for any specific purpose granted at the time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

6.- Where can I complain if I feel that my data is not being handled correctly?

If any interested party considers that their data are not being treated correctly by MAKAN LYDGROUP S.L., they can send their complaints to comunicacion@elgalloazuljerez.com or to the corresponding data protection authority, the AEPD being the one indicated in the national territory, www.agpd.es.

7.- Security and updating of personal data

In order to safeguard the security of your personal data, we inform you that MAKAN LYDGROUP S.L. has adopted all the technical and organisational measures necessary to guarantee the security of the personal data supplied. All this to avoid its alteration, loss, and/or unauthorised processing or access, as required by law, although absolute security does not exist.

It is important that, so that we can keep your personal data up to date, you inform us whenever there is a change in them.

8.- Confidentiality

MAKAN LYDGROUP S.L. informs you that your data will be treated with the strictest care and confidentiality by all the staff involved in any of the processing phases. We will not transfer or communicate your data to any third party, except in the cases provided for by law, or unless the interested party has expressly authorised us to do so.
